2. Definitions

In the following, we would like to inform you about the processing of your personal data when you visit our website and use our content and services.

“Personal data” in the sense of the GDPR means any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier (such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person).

“Processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

With regard to the other used data privacy terms, we refer to the definitions in Art. 4 GDPR.

3. Scope of the processing of personal data

In order to use our website, it is generally not necessary for you to provide data. In certain cases, however, we need your name and address and other information so that we can provide the desired services.

The same applies, for example, to the sending of information material and ordered goods or to the answering of individual questions. Where necessary, we will notify you accordingly. In addition, we only process data that you voluntarily provide to us and, if applicable, data that we automatically collect when you visit our website (e.g. IP address and the names of the pages you have accessed, the browser and operating system you are using, date and time of access, search engines used, names of downloaded files).

If you make use of our services, in general only data that we need to provide the services are collected. As far as we ask you for further data, the information is voluntary.

4. Purposes for the processing of personal data

We will process the data you provide in accordance with the principles of data economy and purpose limitation. The principle of purpose limitation states that data shall be collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes. Further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes is not considered to be incompatible with the initial purposes.

We only process your data to answer inquiries, handle your orders and provide access to certain information or offers to you. Maintaining customer relationships may also require us or a commissioned service provider to use this data to inform you about product offers or to conduct online surveys to fulfill the tasks and requirements set by our customers.

We will only process the data you provide online for the stated purposes. Your data will not be transferred to third parties without your express consent.

5. Disclosure of data to third parties

Your data will only be transmitted to third parties in exceptional cases,
• to external service providers working for us (processors) if this is necessary for the purpose of executing the contract,
• to companies affiliated with us, insofar as this is necessary to fulfill the contractual obligations,
• to state institutions and authorities if we are legally obliged to do so or
• if you consent to this.

We conclude the relevant processing agreements with the processor based on Article 28 of the GDPR. The service companies commissioned by us are obliged by us to maintain confidentiality and to comply with the provisions of the GDPR and the BDSG. The transmitted data may only be used by our service providers to fulfill their task. Any other use of the information is not permitted and is not carried out by any of the service providers we entrust with.

A transmission and further processing of data to state institutions and authorities entitled to receive information only takes place within the framework of the relevant laws or if we are obliged to do so by a judicial decision.

In addition, we do not pass on any data to third parties unless you have given us your express consent.

Of course, we respect it if you do not want to give us your data to support our customer relationship (especially for direct marketing or for market research purposes). We will neither sell your data to third parties nor market it in any other way unless you have given us your consent.

6. Transfers of personal data to a third country

Insofar as it comes to the disclosure or transmission of data to third parties in a third country, i.e. outside the European Union (EU) or the European Economic Area (EEA), and data is further processed as part of the use of third-party services, this is only done based on your consent, a legal obligation, our legitimate interests or if it is necessary to fulfill our (pre) contractual obligations. Subject to legal or contractual permissions, we process or have the data processed in a third country only if the special requirements of Article 44 and the following GDPR are met. This means that processing is carried out, for example, on the basis of special guarantees, such as the officially recognized determination of a level of data protection corresponding to the EU or compliance with officially recognized special contractual obligations (e.g. standard contractual clauses for the transfer of personal data to processors established in third countries “Standard Contractual Clauses” (“SCC”))

7. Legal basis for the processing of personal data

Insofar as we obtain your consent for the processing of personal data, the consent according to point (a) of Article 6(1) of the GDPR is the legal basis for the processing of your data.

When processing personal data that is necessary to fulfill the requested service, we rely on point (b) of Article 6(1) of the GDPR serves as the legal basis.

Insofar as processing of personal data is necessary to fulfill a legal obligation to which our company is subject, point (c) of Article 6(1) of the GDPR serves as the legal basis.

If processing is necessary to safeguard a legitimate interest of our company or a third party and the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, point (f) of Article 6(1) of the GDPR is the legal basis for processing.

8. Deletion of data and duration of storage

We only store your data until the purpose is fulfilled and there are no other legal retention requirements (e.g. commercial law or tax retention obligations).

If you have given us your consent, we will store your data until you revoke your consent, if there is no other legal basis for the processing of your data and is not contrary to legal retention periods of extinction.

In addition, in individual cases, e.g. for evidence purposes, longer storage for defense / enforcement of civil or public law claims may be appropriate.

11. Analysis and tracking tools

11.1 General

When you visit our website, your surfing behavior can be statistically evaluated. This is done primarily with cookies and with so-called analysis programs. Your surfing behavior is usually analyzed anonymously; the surfing behavior cannot be traced back to you. You can object to this analysis or prevent it by not using certain tools. See the following for more information.

11.2 Google Analytics

Our website uses Google Analytics, a web analysis service of Google LLC („Google“), 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA. Google Analytics uses so-called cookies, text files saved onto your computer that allow your use of the website to be analyzed.

The information on your website use generated by cookies is generally transmitted to a Google server in the USA where it is saved. If IP-anonymisation is activated on our website, your IP address will partially be made unidentifiable by Google within a Member state of the European Union or in another state party to the European Economic Area Agreement (so-called IP masking).

Only in exceptions will your full IP address be transferred to a Google server in the US and be made unidentifiable there. On behalf of the operators of this website, Google will use this information to assess your use of this website, to compile reports about website activity and to perform additional services related to use of the website and the Internet for the website operators.

The IP address transmitted by your browser through Google Analytics will not be merged with other Google data. You can prevent cookie storage through your browser settings at any time. However, please note that you may not be able to use every function of this website. Furthermore, you can prevent the collection of cookie-generated data (including your IP address) on your use of the website and the processing of this data by Google by downloading and installing the browser plug-in provided under the following link: http://tools.google.com/dlpage/gaoptout?hl=en.

As an alternative to the browser plugin and on browsers on mobile devices, you may also prevent data collection by Google Analytics by activating the following link which will install an opt-out cookie that will block any future collection of your data when visiting our website. Please note that this link must be activated again if you delete your cookies.

The data will only be transferred if the special requirements of Article 44 and the following GDPR (e.g. SCC with additional measures).

Data processing, in particular the setting of cookies, takes place with your consent on the basis of point (a) of Article 6(1) of the GDPR. You can revoke your consent at any time with future effect by clicking on cookie settings / following link https://www.project-gewerbe.com/#cmpscreencustom. Then an opt-out cookie will be set, which prevents the collection of your data on future visits to this website.

For Google's Data Privacy Statement, please see https://policies.google.com/privacy?hl=en. For the Google Terms of Service, please see https://policies.google.com/terms?hl=en (in German).

11.3 Google Ads

We use "Google Ads" on our website, a service of Google Ireland Limited, Google Building Gordon House, Barrow St, Dublin 4, Ireland ("Google").

Google Ads enables us to draw attention to our attractive offers with the help of advertising material on external websites.

This enables us to determine how successful individual advertising measures are. These advertising materials are delivered by Google via so-called "AdServer". For this purpose, we use so-called AdServer cookies, which can be used to measure certain parameters for measuring success, such as the display of ads or clicks by users. If you access our website via a Google ad, Google Ads stores a cookie on your PC.

These cookies usually lose their validity after 30 days. They should not be used to personally identify you. The following information is usually saved as analysis values for this cookie: unique cookie ID, number of ad impressions per placement (frequency), last impression (relevant for post-view conversions), opt-out information (marking that the Users no longer want to be addressed).

These cookies enable Google to recognize your web browser. If a user visits certain pages of the website of an Ads customer and the cookie stored on their computer has not yet expired, Google and the customer can recognize that the user clicked on the ad and was redirected to this page. A different cookie is assigned to each Ads customer. Cookies cannot therefore be tracked via the websites of Ads customers.

We ourselves do not collect and process any personal data in the advertising measures mentioned. We only receive statistical evaluations from Google. Based on these evaluations, we can see which of the advertising measures used are particularly effective. We do not receive any further data from the use of the advertising material, in particular we cannot identify the users based on this information. Due to the marketing tools used, your browser automatically establishes a direct connection to the Google server.

We have no influence on the scope and further use of the data collected by Google through the use of Google Ads. To the best of our knowledge, Google receives the information that you have called up the corresponding part of our website or clicked on an advertisement from us.

If you have a Google user account and are registered, Google can assign the visit to your user account. Even if you are not registered with Google or have not logged in, there is a possibility that Google will find out and save your IP address.

We use Google Ads for marketing and optimization purposes, in particular to display relevant and interesting ads for you, to improve reports on campaign performance and to achieve a fair calculation of advertising costs.

In this case, a so-called opt-out cookie is stored in your browser, which means that Google does not collect any session data.

In the event that personal data is transferred to Google LLC., which is based in the USA, Google LLC has taken appropriate measures (such as concluding EU-SCC and additional measures) which ensure compliance with the level of data protection applicable in the EU.

You can prevent the installation of cookies by deleting existing cookies and deactivating the storage of cookies in the settings of your web browser. We would like to point out that in this case you may not be able to use all functions of our website to their full extent. The storage of cookies can also be prevented by setting your web browser so that cookies from the domain "www.googleadservices.com" are blocked (https://www.google.de/settings/ads). We would like to point out that this setting will be deleted if you delete your cookies. You can also deactivate interest-based ads using the link http://optout.aboutads.info. We would like to point out that this setting will also be deleted if you delete your cookies.

11.4 Google Tag Manager

Our website uses Google Tag Manager. The Google Tag Manager is a service of Google Ireland Limited, Google Building Gordon House, Barrow St, Dublin 4, Ireland (“Google”). Google Tag Manager is a solution that provides a surface for marketers to manage website tags. Google Tag Manager is a cookie-free domain that does not collect personal data. Although Google Tag Manager activates other tags which may collect data, Google Tag Manager does not access this data. In case of deactivation on the domain or cookie level, the deactivation will remain in place for all tracking tags implemented through Google Tag Manager.

Further information on data protection can be found on the following Google websites:

11.5 Google Remarketing

This website uses the remarketing function of Google. This function allows us to display interest-based advertisements to visitors of our website. This is done using cookies stored in your browser, via which your usage behavior when visiting different websites is recorded and evaluated by Google. This allows Google to determine your previous visit to our website. According to its own statements, Google does not combine the data collected as part of the remarketing with your personal data, which may be stored by Google. According to Google, pseudonymization is used in remarketing in particular.

In the event that personal data is transferred to Google LLC., which is based in the USA, Google LLC has taken appropriate measures (such as concluding EU-SCC and additional measures) which ensure compliance with the level of data protection applicable in the EU.

You can prevent participation in this tracking procedure in several ways:
• by setting your browser software accordingly, in particular suppressing third-party cookies means that you will not receive any advertisements from third-party providers;
• by installing the plug-in provided by Google under the following link: https://www.google.com/settings/ads/plugin;
• by deactivating the interest-based ads of the providers that are part of the self-regulation campaign "About Ads" via the link http://www.aboutads.info/choices. This setting will be deleted if you delete your cookies;
• by permanent deactivation in your browsers Firefox, Internet Explorer or Google Chrome under the link https://www.google.com/settings/ads/plugin;
• by corresponding cookies setting. We would like to point out that in this case you may not be able to use all functions of this offer to their full extent.

Further information on data protection at Google can be found here: http://www.google.com/intl/de/policies/privacy and https://services.google.com/sitestats/de.html.

11.6 Google DoubleClick-Cookies

Our website uses cookies of Google DoubleClick, an analysis service of Google Ireland Limited, Google Building Gordon House, Barrow St, Dublin 4, Ireland ("Google").

DoubleClick uses cookies, small text files that are saved locally in the cache of your web browser on your device. Google uses a cookie ID to record which advertisements are displayed in which web browser. This can prevent ads from appearing multiple times. DoubleClick can also use the cookie IDs to record so-called “conversions” that relate to ad requests. This is the case, for example, if you see a DoubleClick ad and later go to the advertiser's website with the same web browser and buy something there. According to Google, the aforementioned cookies do not contain any personal data. By using DoubleClick, your browser automatically establishes a direct connection to the Google server. We have no influence on the scope and further use of the data collected by Google through the use of DoubleClick.

We use DoubleClick for marketing and optimization purposes, especially to serve ads that are relevant and interesting to you, to improve reports on campaign performance, or to prevent you from seeing the same ads multiple times.

In this case, a so-called opt-out cookie is stored in your browser, which means that Google does not collect any session data.

You can prevent the installation of cookies by deleting existing cookies and deactivating the storage of cookies in the settings of your web browser. We would like to point out that in this case you may not be able to use all functions of our website to their full extent. The storage of cookies can also be prevented by setting your web browser so that cookies from the domain "www.googleadservices.com" are blocked (https://adssettings.google.de). We would like to point out that this setting will be deleted if you delete your cookies. You can also deactivate interest-based ads using the link https://optout.aboutads.info. We would like to point out that this setting will also be deleted if you delete your cookies.

You can find further information on data use by Google, setting and objection options as well as other data protection information in Google's Data Privacy Statement (https://policies.google.com/privacy?hl=de&gl=de).

11.7 Google Maps

This website uses Google Maps of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, or if the service is provided in the European Union (EU), Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland („Google“). Google Maps is a web service for displaying interactive (land) maps to visually display geographic information. By using this service, our location will be shown to you and any travel will be easier.

Data is not transferred to and stored on Google's servers when the sub-pages on which the Google Maps map is integrated are opened. The map is statically integrated by means of a preview image until the Google Maps service is activated. The Google Maps service is only activated and information about your use of our website (such as your IP address) transmitted to Google servers and stored there when you click on the preview image. Here, it can also be transmitted to the servers of Google LLC. in the US. This takes place regardless of whether Google provides a user account that you are logged in to or whether there is a user account. If you are logged in to Google, your data will be assigned directly to your account. If you do not want your profile to be assigned to Google, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates them. The collection, storage and evaluation are carried out in accordance with point (f) of Article 6(1) of the GDPR based on Google's legitimate interest in displaying personalized advertising, market research and / or the needs-based design of Google websites. You have the right to object to the creation of these user profiles, but you must contact Google to exercise them.

In the event that personal data is transferred to Google LLC., which is based in the USA, Google LLC has taken appropriate measures (such as concluding EU-SCC and additional measures) which ensure compliance with the level of data protection applicable in the EU.

If a corresponding consent to the setting or storage of cookies has been requested and granted, the processing takes place exclusively on the basis of point (a) of Article 6(1) of the GDPR. You can revoke your consent at any time with future effect by clicking on the following link https://www.project-gewerbe.com/#cmpscreencustom. Then an opt-out cookie will be set, which prevents the collection of your data on future visits to this website.

If you do not consent to the future transmission of your data to Google when using Google Maps, there is also the option of completely deactivating the Google Maps web service by switching off the JavaScript application in your browser. Google Maps and thus the map display on this website can then not be used.

For more information, please see http://www.google.de/intl/de/policies/privacy/

The terms of use of Google Maps can be found at https://www.google.de/intl/de/policies/terms/regional.html und unter https://www.google.com/intl/de_US/help/terms_maps.html.

11.8 Google Fonts

On our website, we use the Google Fonts font library provided by Google LLC, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, to display fonts in a uniform and user-friendly manner. This constitutes a legitimate interest within the meaning of Art. 6 para. 1.1 (f) GDPR.

If your browser does not support Fonts, a standard font from your computer will be used.

When you open a webpage, your browser downloads the necessary fonts to your browser cache.

This automatically establishes a connection to Google Inc., as Fonts are integrated via an interface (API) to Google services. It cannot be ruled out that Google may become aware that our website has been accessed via your IP address. This transmitted data may be processed by Google, something over which we have no control.

You can find further information on Google Fonts at https://developers.google.com/fonts/faq and in the Google Inc. privacy policy at https://www.google.com/policies/privacy/. You can find further information on Google API at https://www.google.com/intl/de/policies/privacy/.

12. Videoplattformen

12.1 Videoportal Vimeo, Vimeo-Channels

Our websites contain so-called embedding of videos on Vimeo. However, these only enable the connection to Vimeo. Vimeo is an offer from Vimeo LLC. Based at 555 West 18th Street, New York, New York 10011 (hereinafter referred to as "Vimeo"). However, this embedding only enables the connection to Vimeo.

Data is not transferred to and stored on servers of the Vimeo LLC when the sub-pages on which the videos of the platform Vimeo is embedded are opened. The video is statically integrated by means of a preview image until the videoservice is activated. The video streaming service is only activated and information about your use of our website (such as your IP address) transmitted to Vimeo servers and stored there when you click on the preview image.

Here, it can also be transmitted to the servers of Vimeo LLC. in the US. 13. Social Media

Our website uses the following links and social media services:

13.1 Facebook

Our website contains links to the social network Facebook, 1601 Willow Rd, 94025 Menlo Park, USA or if the service is provided in the European Union (EU), Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland (“Facebook“). You can recognize the Facebook plugin/ (image) link by the button with the Facebook logo (small "f" in a round shape).

If you use the Facebook link, that means when you click on the button, information that you have accessed certain pages of our website will be forwarded to the Facebook servers. For Facebook users who are logged in at the same time, this means that the usage data is assigned to their respective personal account. If you click on the Facebook button, this information is transmitted from your browser directly to Facebook and stored there. Even if you are not a member of the social network mentioned, there is still the possibility that Facebook will determine and save your IP.

Facebook stores your IP address even if you are not a member of Facebook. However, only an anonymized IP address should be saved for European users.

Information generated by Facebook is usually transferred to a Facebook server and stored there. This can also result in a transmission to the Facebook Inc. servers in the USA. Facebook Inc., based in the USA, has taken appropriate measures (such as concluding EU SCC) which ensure compliance with the level of data protection applicable in the EU.

We use the Facebook links based on our legitimate interests in accordance with point (f) of Article 6(1) of the GDPR. Here, these are the analysis, optimization and economic operation of our online offer.

If a corresponding consent to the setting or storage of cookies has been requested and granted, the processing takes place on the basis of point (a) of Article 6(1) of the GDPR. You can revoke your consent at any time with future effect by clicking on the following link https://www.project-gewerbe.com/#cmpscreencustom.

For further information, in particular the exact purpose and scope of the data collection, please visit https://de-de.facebook.com/policy.php.

You can find the privacy settings, including the possibility to object to the use of your data for advertising purposes, here

13.2 Facebook Pixel

With your consent, we use the so-called "Facebook Pixel" on our website. This is an offering provided by the social media platform Facebook and is operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA or, in the case that you are based in the EU, by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook").

With the help of Facebook Pixel, it is possible for Facebook to identify the visitors to our website as a target group for the presentation of ads (so-called "Facebook ads"). In accordance with this, our aim in using Facebook Pixel is to only show the Facebook ads that we use to those Facebook users who have shown an interest in our online offering or who display certain characteristics (e.g. interest in certain topics or products, determined from the websites they have visited), whose data we then forward to Facebook (so-called "custom audiences"). In this way, we hope to ensure that our Facebook ads correspond to the potential interest of the users and are not perceived as being annoying or bothersome. With the "conversion tool" provided by Facebook Pixel, we can also follow your actions after you have viewed or clicked on a Facebook ad. This allows us to monitor and analyse the effectiveness of our Facebook ads for statistical purposes and for the purpose of market research.

The Facebook Pixel allows your browser to automatically set up a direct connection to the Facebook server. This may also result in the transmission of data to the servers of Facebook Inc. in the USA. Facebook uses standard contractual clauses approved by the European Commission and uses adequacy decisions with regard to certain countries as a basis to provide a legitimate case for the transmission of data from the EER to the USA or to other third countries.

We have no influence on the amount of data that is collected or on the further use of the data that Facebook collects through the use of this tool and are therefore providing you with information in accordance with the current level of our knowledge: the inclusion of the Facebook Pixel means that Facebook receives the information that you have clicked on one of our ads or have called up the relevant website from our online provision. Provided you are registered with one of Facebook's services, Facebook is able to assign the visit to your account. Facebook may use this information for the purposes of advertising, for market research and for the needs-based design of their Facebook pages. To do this, Facebook and their partners create user profiles, interest profiles and relationship profiles, e.g. to evaluate your use of our website in regard to the ads that are shown to you on Facebook, to inform other Facebook users about your activities on our website and to perform further services associated with the use of Facebook. This may also require cookies to be stored on your PC.

Provided you are registered with Facebook, you can adjust your settings to determine the type of ads that are shown to you on Facebook by going to the page set up for this purpose by Facebook and following the instructions with regard to the settings for use-based advertising: https://www.facebook.com/settings?tab=ads. The settings take effect independently of the platform you are using, i.e. they will apply to all your devices, including both desktop computers and mobile devices.

Even if you are not registered with Facebook or have not logged in, it is possible that the provider can obtain details of your IP address and further identifying characteristics and can store this information.

Please refer to Facebook's Privacy Policy for full details of the purpose and scope of the data collected and the further processing and use of the data by Facebook, as well as details of your rights in this respect and the options to change your settings to protect your privacy.
